Welcome to Niveusly (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your use of our website, applications, and services (collectively, the “Service”). By accessing or using Niveusly, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Niveusly. By using the Service, you represent and warrant that you meet this requirement.

2. Our Service

Niveusly provides users with the ability to upload files or content to generate timestamped proof of creation. This proof records the date and time a work was submitted, serving as evidence of existence.

Verify the identity of the creator.
Guarantee legal ownership or enforce intellectual property rights.
Provide legal advice or act as a law firm.

The Service is an evidentiary tool, not a substitute for copyright, patent, or trademark registration.

File Handling

When you upload a file for certification, the file is processed only to generate timestamped proof. Files are temporarily stored on Niveusly Germany datacenters for the duration of the process (usually a fraction of a second) and are not stored permanently. Only the resulting cryptographic proof (hash and timestamp) is kept.

3. User Responsibilities

When using Niveusly, you agree that you will not:

Upload content you do not have the right to use.
Infringe, misappropriate, or violate any intellectual property rights of others.
Use the Service for unlawful, harmful, or fraudulent purposes.
Attempt to interfere with or disrupt the Service’s operation.

You are solely responsible for the content you upload and any claims made using the Service.

4. Accounts

To access certain features, you may need to create an account. You are responsible for:

Maintaining the confidentiality of your login credentials.
All activity under your account.
Notify us immediately if you suspect unauthorized use of your account.

5. Payments and Subscriptions | Refund policy

Some features require payment or a subscription.

Fees are displayed at checkout and are subject to change.
Subscriptions automatically renew unless cancelled before the renewal date except for PayAsYouGo, one-time charges.
All payments are non-refundable, except where required by law.

6. Intellectual Property

You retain all rights to your original content uploaded to Niveusly.
By using the Service, you grant us a limited license to process, store, and display your content solely for the purpose of providing the Service.
Niveusly’s trademarks, logos, software, desing and technology remain our exclusive property.

7. Privacy

Your privacy matters to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available.” We make no warranties, express or implied, including but not limited to:

Accuracy, reliability, or completeness of the Service.
Fitness for a particular purpose.
Non-infringement.

We do not guarantee that proof generated through Niveusly will be accepted by courts, authorities, or third parties in every jurisdiction.

9. Limitation of Liability

To the maximum extent permitted by law:

Niveusly shall not be liable for any indirect, incidental, consequential, or punitive damages.
Our total liability to you for any claim shall not exceed the amount you paid to use the Service in the past 12 months.

10. Termination

We may suspend or terminate your account at any time if:

You violate these Terms.
We are required by law.
We discontinue the Service.

You may stop using Niveusly at any time by closing your account.

11. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use of Niveusly after changes become effective constitutes acceptance.
